1.Object

1.1. Overview

These Terms and Conditions of Use (hereinafter called the “T&Cs”) are intended to restrict and control the conditions of access and the use of the OCEAN71.COM website (Hereinafter referred to as “the site”).

The parties to these T&Cs are in the first part the Users of the site and of the second part OCEAN MAGAZINE SARL a limited liability company registered under Swiss law and having its registered office at : OCEAN71 Magazine – C/O Fiduciaire José Giavazzi SA – Place du Marché 8, Case Postale 281 – 1820 Montreux – Switzerland (Hereinafter referred to as “the Editor”).

 

2. Acceptance of the Terms and Conditions of Use.

By accessing any part of the site the Users agree that they have read understood and accept without reserve these T&Cs.

 

3. Visiting the site and posting comments

3.1. Overview

The Users have free access to OCEAN71.COM.

 

4. Specific obligations for all Users

The Users undertake to use the contents of the website OCEAN71.COM for legal purposes only.

 

5. Cookies and information gathering

The Editor reserves the right to place cookies whenever the OCEAN71.COM website is accessed. The Users can however refuse to accept these cookies by configuring this option in their browser software.

The Editor’s servers are not configured to collect personal information from the Users apart from the following: the source of the connection (service provider), the IP address, the type and version of the browser used. Under no circumstances does the Editor collect email addresses unless the User has deliberately provided it. Statistics gathered on traffic and the cookies the Editor sets on the Users’ computer are only intended to allow an analysis of the traffic flow to the OCEAN71.COM website in order to improve its content. Statistics relating to the navigation of the Users are never identified personally.

Users are reminded that Subscribers will have to supply the Editor with the following personal information: Last name, First name, User name and Email address.

 

6. Intellectual property

The content of the OCEAN71.COM website including all trade marks, logos and domain names are protected by the current laws on intellectual property and belong to the Editor. In accordance with the current Swiss legislation only private use is permitted. No part of the OCEAN71.COM website may be copied, reproduced, broadcast, sold, published, modified, re-edited, transmitted, distributed or exploited in any way, on any medium, be it partial or complete, without the prior written approval of the Editor.

 

7. Disclaimer

Under no circumstances shall the Editor be held liable for any damage of any kind, direct or indirect, suffered by a User as a result of an interruption of service or technical failure of the OCEAN71.COM website.

This disclaimer applies in particular in the event of a failure of the server, a virus attack or as a result of hacking. No guarantee is offered to the Users in relation to the speed, security or compatibility of the OCEAN71.COM website. In the event of a defect in the OCEAN71.COM website the Users accept total responsibility for any costs of maintenance, repair or correction to their own hardware and software.

The Editor will incur no liability in the case of force majeure.

 

8. Modification and termination of the OCEAN71.COM website

The Editor reserves the right to modify, interrupt or permanently terminate the publication of the OCEAN71.COM website.

 

9. Modifications to the Terms and Conditions of Use

The Editor may amend the T&Cs at any time. Users are responsible for checking the contents regularly. Any clause of these T&Cs that may be in conflict with current Swiss law shall be separable and any nullity, be it total or partial, of one clause will not affect the validity of the rest of the clause in question or the other clauses of these T&Cs.

 

10. Applicable law and Jurisdiction

10.1 Applicable Law

In the case of a dispute the current T&Cs together with the Users Charter shall be taken as the basis in law. The application of Swiss law being complimentary.

10.2 Legal Jurisdiction

The Users accept that the laws of Montreux in Switzerland shall apply to any dispute.
